Docoon terms and conditions of use

Docoon, registered in the Paris Trade and Companies Register under number 338 698 384 and headquartered at 81, rue Réaumur 75002 Paris, is a company specializing in the dematerialization of documents (invoices, contracts, pay slips) and the electronic transport (transmission and reception) of fax, email, SMS, voice and mail messages.
This site is reserved for B2B Users, professionals within the meaning of the French Consumer Code and Commercial Code.

Browsing the website implies acceptance of these general terms and conditions of use ("GTCU"), of which the present online version alone is enforceable for the entire duration of use of the website https://docoon.com or the corresponding application (jointly referred to hereinafter as the "Site"). In the event of disagreement, the User must immediately cease browsing the Site.
We therefore recommend that you read the following carefully.
For each Service, specific conditions may also be applicable, and are, where applicable, accessible in the "Special Conditions" found on the dedicated web pages for each Service. In the event of contradiction between the GCU and the Special Conditions, the latter shall prevail.

1. Intellectual property

The photographs, trademarks, texts, slogans, drawings, images, animated sequences with or without sound, as well as all works and other elements integrated into the Site are the property of Doccon or third parties having authorized Docoon to use them.
The logos, icons and graphic chips represented on the Site are protected by copyright and by articles L.511.1 et seq. of the French Intellectual Property Code concerning the protection of registered designs..1 et seq. of the French Intellectual Property Code concerning the protection of registered designs.
Any reproduction, representation, use or modification, by any process whatsoever and on any medium whatsoever, of all or part of the site, of all or part of the various works that make it up, without having obtained the prior authorization of DOCOON is strictly forbidden, constitutes an infringement of copyright and may give rise to civil and/or criminal legal proceedings, as well as the payment of damages.

2. Site content and security

Docoon declines all responsibility in the event of delays in updating, as well as in the event of interruption or temporary unavailability of access to all or part of the Site.
Docoon reserves the right to correct, modify and update the content of this Site at any time and without prior notice.
The User acknowledges that he/she has the necessary skills and means to access and use this Internet site and acknowledges that he/she has secured the computer configuration he/she is using, in particular by equipping himself/herself with at least an anti-virus program.

The Website implements organizational, technical, software and physical digital security measures to protect personal data against alteration, destruction and unauthorized access.
However, it should be noted that the Internet is not a completely secure environment and the Website cannot guarantee the security of the transmission or storage of information over the Internet.

3. Liability

When using the website, the User is responsible for his or her actions on the Site and undertakes not to undermine public order and to comply with the laws and regulations in force, to respect the rights of third parties and the provisions of these GCU. Each User of the Site is obliged to :

  • Behave loyally and like a good family man
  • Be honest and sincere in the information provided to Docoon
  • Use the website in accordance with the purpose described in these T&Cs
  • Do not attempt to divert users to a competing site or service
  • Not to attempt to undermine the automated data processing systems used to put the website online.

DOCOON makes every effort to ensure the security of the Site, but use of the Internet involves inherent network risks. Docoon declines all responsibility in the event of :

  • temporary inability to access the website or its content for technical maintenance or updating of published information
  • viral attacks
  • incomplete or erroneous information from a User
  • abnormal use or illicit exploitation of the website. The User shall be solely liable for any damage caused to third parties and for the consequences of any claims or actions arising therefrom.

Docoon cannot be held liable for the use of the Site and/or for any damage resulting from the use of the Site or information on the Site by the User or by a third party. In any event, this liability may not exceed €100 for any damage whatsoever.

The User undertakes not to circumvent, modify, decompile, deactivate or in any other way interfere with the Site's security systems or with the functionalities that prevent or restrict its use.

The User accepts and undertakes to comply with local, national and international laws when accessing the Site.

4. Hyperlinks

The Site authorizes the creation of a hypertext link to its content, subject to :

  • express, prior, written authorization from Docoon du Site, who remains free to refuse such authorization without having to justify it AND
  • not to use the "deep linking" technique, i.e. the Site's pages must not be nested within the pages of another site, but accessible by opening a dedicated window; AND
  • mention the source by means of a hypertext link pointing directly to the targeted content.

This authorization does not apply to websites disseminating information of a controversial, pornographic or xenophobic nature, or which may, to a large extent, offend the sensibilities of the general public, for which no hypertext link to the Site may be created.

Docoon declines all responsibility for the content of linked sites, regardless of the type of link established from or to the Site.

5. Personal data protection

Docoon undertakes to comply with the regulations in force applicable to the processing of personal data and, in particular, the provisions of Law no. 78-17 of January 6, 1978 as amended and Regulation EU 2016/679 of the European Parliament and of the Council of April 27, 2016 ("RGPD").

7. General provisions

In the event of the invalidity of any provision of these GCU, the other provisions shall remain in full force and effect.
The failure of either party to insist, temporarily or permanently, on the application of any provision of these GCU shall not be deemed a waiver of the rights held by that party. Any exchange of correspondence, writings, e-mails, etc. shall not call into question the terms of these GCU.

ANY DISPUTE ARISING IN CONNECTION WITH THE USE OF THE SITE IS SUBJECT TO FRENCH LAW. THIS APPLIES TO BOTH SUBSTANTIVE AND PROCEDURAL RULES, IRRESPECTIVE OF THE PLACE OF DAMAGE OR THE NUMBER OF DEFENDANTS, EVEN IN THE CASE OF EMERGENCY OR CONSERVATORY PROCEEDINGS, WHETHER IN CHAMBERS OR ON APPEAL. THE COURTS WITHIN THE JURISDICTION OF THE PARIS COURT OF APPEAL SHALL HAVE JURISDICTION.
