Reform of electronic invoicing – A new decree simplifies the procedure for registering as a PDP

This is information that electronic invoicing stakeholders have been waiting for. Decree No. 2024-266 of March 25, 2024, relating to the widespread use of electronic invoicing in transactions between parties subject to value-added tax and the transmission of transaction data, will simplify the initial registration of companies as PDPs (Partner Dematerialization Platforms). Indeed, while the decree of October 7, 2022 required "technical test reports" with the Public Invoicing Portal (PPF) prior to PDP approval, the PPF was not yet operational, which prevented initial registrations. The new decree simplifies matters, since it " provides, for registration applications submitted before the public invoicing portal test environment is available, a transitional regime allowing the registration of partner dematerialization platform operators. In this case, the tax authorities may issue the registration subject to the operator subsequently producing the aforementioned technical test reports (...). These reports shall be produced by the operator applying for registration within three months of the aforementioned technical environment being made available. " 

The legislator takes care to specify that the measure also applies to registration applications submitted prior to the publication of this decree and which are currently being processed.

A scanned signature does not have the same value as an electronic signature.

In an article, the editorial staff of Les Echos Emploi Les Echos Emploi reports on a decision by the Court of Cassation, Commercial, Financial, and Economic Chamber, dated March 13, 2024 arguing that a scanned signature does not have the same value as an electronic signature and can therefore be legitimately contested. It therefore ruled in favor of the signatories of a promise of sale who contested the legal validity of their signatures on the grounds that they were simply scanned. This decision is likely to set a precedent and serves as a reminder that, according to the judges, a scanned signature does not provide certainty as to the identity of the signatory or their consent to the act.

France has presented its roadmap for digital development

On Monday, March 25, the Directorate-General for Enterprise presented its roadmap for digital development to the Brussels authorities. The document is intended to meet the objectives of the "Digital Decade" plan adopted by the European Commission for 2030. It reveals that the French government is focusing some of its priorities on the digital transformation of businesses, particularly micro-enterprises and SMEs. At the European level, French SMEs are less advanced than their European counterparts, which is why the government intends to continue and accelerate its policy of digitizing microbusinesses and SMEs, in particular through the France Num partnership initiative.

Rapid growth in SMS push notifications

It's a strong trend: the SMS marketing (push SMS) market is growing rapidly. The French Association for the Development of Multi-Operator Multimedia Services and Uses (AF2M) has published the sixth edition of its SMS Marketing Barometer, in collaboration with the Digital Alliance. The number of messages sent by brands in 2023 grew by 4.1% compared to 2022. Transactional SMS (access codes, payment validation, delivery, etc.) alone accounted for 8 billion messages sent in 2023, compared to just over 5 billion for promotional SMS (promotional offers, advertising, drive-to-store).
