Alert distribution & RGPD & Municipalities

The distribution of alerts in the same way as MULTI-CANAL communication is subject to the RGPD.

Indeed, even a municipality wishing to alert all or part of its population in the event of an exceptional crisis (attack, flood, heatwave, nuclear incident, epidemic...) will have to set up and maintain nominative files.

The CNIL reminds us that :

  • Entry in these registers must be voluntary, on the part of the person concerned or a third party acting on his or her behalf. Their sole purpose is to enable the targeted intervention of health and social services in the event of the implementation, under the authority of the prefect, of the departmental alert and emergency plan.
  • The use of pre-existing files, by those authorized to access them (staff of the municipality or local actor holding the data), can only be used to inform people of the existence of the register (no automatic registration).
  • In all cases (registration requested by the person concerned or, on his or her behalf, by a third party), the mayor must send the person concerned an acknowledgement of receipt within 8 days, informing him or her that, in the absence of opposition on his or her part, receipt of this acknowledgement constitutes confirmation of his or her agreement to appear on the register.
  • In addition to taking into account requests for rectification and deletion made by the persons concerned on their own initiative (e.g.: moving out of or within the commune), it is recommended that the mayor send them an annual reminder, by means of a dedicated message, of the need to keep him/her informed of any change in their situation.
